All of us are responsible for own debts. When the time comes (and hopefully it does not) that you fall behind pay in your debt payments, or maybe your account gets an error, you might soon find that a debt collector will be contacting you. Debt collection workers could be any person, not a creditor, that continually makes collections on debts that are owed to their clients. This will include people that work at debt collection agencies or even possibly attorneys who will collect debts on a frequent basis. When someone contacts you to collect on debts you owe, you have the right to be treated fairly during this action.

You might be surprised to find out that many people in the past have suffered great harm physically and emotionally by debt collectors that have used detrimental methods to collect on various debts. There is an Act known as the Fair Debt Collection Practices Act or FDCPA that will be applicable to household, family and personal related debts owed. Debts in this case will usually include money owed on big-ticket items like a house, medical expenses, automobile, credit cards or other instances. The act stated above basically legally guards against debt collector workers from employing deceptive, unfair or abusive methods in order to collect on these outstanding debts. This act allows for:

  1. Debt collection workers can only make contact with you between 8 a.m. And 9 p.m.
  2. These workers cannot contact you at your place of employment when you're employer prohibits this.
  3. They may not take action that abuses, harasses or oppresses you as a debt ower.
  4. They may not lie to you when making collection on debts like maybe threatening you or implying that you have instigated a crime.
  5. They always have to identify themselves when contacting you over the phone.
  6. If you ask them to stop contacting you in writing, they have to comply.


The laws within this act allow you to be fairly treated has a regular person should be even though you owe debts that are outstanding. Since the debt collection industry has in the past been very competitive, they implemented tactics that often severely hurt the person owing the debts. Now, less instances occur where the person owing debts has been unfairly treated by the collection agency workers.
